1. Acceptance of Terms

By accessing and using neko, you accept and agree to be bound by these terms. The Service is provided and operated by the service operator (the “Operator”). This is an experimental AI character chat platform for research and entertainment purposes.

2. Description of Service

neko is an experimental platform that allows users to interact with AI-powered characters through text-based conversations. The service is provided 'as is' and is subject to ongoing development and changes as part of our experimental approach.

3. User Accounts and Registration

To access certain features, you may need to create an account. You are responsible for:

Maintaining the confidentiality of your account information
All activities that occur under your account
Providing accurate and current information
Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the service to:

Examples of prohibited content (non-exhaustive):

Content that violates applicable laws or promotes illegal activity
Content that infringes intellectual property or privacy rights
Hate speech, harassment, or threats of violence
Sexually explicit or exploitative material, especially involving minors
Promotion of self-harm, suicide, or eating disorders
Deepfakes, impersonation, or unauthorized recordings
Attempts to interfere with or bypass security measures

5. AI Character Interactions

Please understand that:

AI characters are artificial and their responses are generated by algorithms
Conversations should not be considered as professional advice
AI responses may occasionally be inaccurate or inappropriate
The service is experimental and character behaviors may change
You should not develop unhealthy dependencies on AI interactions
AI responses are generated using third-party model providers (e.g., OpenAI, Google Gemini) under their own terms of service.
Your prompts and conversations may be transmitted to and processed by third-party AI providers, and their terms and privacy policies apply. Please avoid including sensitive personal information.
We do not currently use your content to train our own or third-party models. If we later use it for model training, we will provide prior notice and obtain consent, applying de-identification/pseudonymization and offering an opt-out.

6. Content and Intellectual Property

All content, characters, and intellectual property on neko are owned by neko or used with permission. You retain ownership of content you create, but grant neko and its service providers (including third-party AI/infrastructure) a worldwide, non-exclusive, royalty-free, sublicensable license to use it for operating, maintaining, improving the service, security/fraud prevention, backup, and legal compliance. Public marketing use requires separate consent. Upon deletion/termination, we remove it from live systems and roll backups off periodically; derived data (logs, statistics, de-identified data) may not be retrievable.

7. Experimental Nature

This is an experimental platform. Features may change, be removed, or experience downtime without notice. We are not liable for any loss of data or service interruptions that may occur during our experimental development process.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using our service, you consent to our data practices as described in the Privacy Policy.

9. Limitation of Liability

neko and the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our liability is limited to the maximum extent permitted by law.

10. Termination

We may terminate or suspend your account at any time for violations of these terms. You may terminate your account and delete your data at any time; upon termination, your right to use the service ceases immediately. Except for data we must retain under law (e.g., payment and accounting records), your data is removed from live systems upon deletion, and backups roll off on a periodic schedule. Payment-related information is deleted after the legally required retention period. Derived or de-identified data (e.g., logs, statistics) may not be retrievable.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.

13. User-Generated Content and Responsibility

neko is a platform for AI-based character interactions, and users may create or share content, including character prompts and conversations. You are solely responsible for any content you create or interact with. You represent and warrant that your content does not infringe third-party copyrights, trademarks, publicity rights, or confidential information, and you will indemnify neko for related claims. We may remove or restrict content that is offensive, unlawful, or infringing, and repeat infringers may face account restrictions or termination. You may report infringements via in-service reporting tools or email/Discord support; we will act on valid notices promptly and may provide a counter-notice channel. Users must ensure their contributions comply with applicable laws and community standards.

14. AI Output Ownership

AI-generated outputs (text, images, etc.) may have uncertain legal protection. You may use them on a non-exclusive basis, and neko may store and analyze such outputs for service quality, security, improvement, and legal compliance. You must use AI outputs without infringing others’ rights; you are responsible for any infringement claims.

15. Reporting and Takedown

If you suspect infringement (copyright, trademark, publicity rights, etc.), use the in-service reporting tools or contact us via email (zombcat@nekochat.xyz) or the #contact-us channel in our Discord server. Provide necessary information (identifiable links or screenshots, proof of rights, contact details). If the notice is valid, we will promptly remove or block the content and may offer a counter-notice channel. Repeat infringers may be restricted or terminated.

16. Mature and Sensitive Content

Some AI character interactions may involve fictional scenarios with mature or sensitive themes. neko does not moderate every response and makes no guarantees about the suitability of content. Use discretion when engaging with AI characters. This service is not intended for users under the age of 18.

17. Governing Law and Jurisdiction

These terms shall be governed by and interpreted in accordance with the laws of the Republic of Korea. Any disputes arising from or related to neko shall be subject to the exclusive jurisdiction of Korean courts.

18. Payments and Refunds

neko uses a third-party payment processor, Toss Payments, to securely handle transactions. By making a purchase through our platform, you agree to the following:

You are responsible for reviewing the purchase details before confirming payment.
Refunds are permitted only for unused cat point packages within 7 days of purchase. Partial or full usage voids refund eligibility. Paid cat points never expire, while promotional or free cat points must be used within one year of issuance and are consumed before paid cat points.
Canceled payments are processed through Toss Payments, and may take several business days to reflect depending on your payment method.
