1. Acceptance of Terms

By accessing and using nekochat, you accept and agree to be bound by these terms. The Service is provided and operated by the service operator (the “Operator”). This is an experimental AI character chat platform for research and entertainment purposes.

2. Description of Service

nekochat is an experimental platform that allows users to interact with AI-powered characters through text-based conversations. The service is provided 'as is' and is subject to ongoing development and changes as part of our experimental approach.

3. User Accounts and Registration

To access certain features, you may need to create an account. You are responsible for:

Maintaining the confidentiality of your account information
All activities that occur under your account
Providing accurate and current information
Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the service to:

Examples of prohibited content (non-exhaustive):

Content that violates applicable laws or promotes illegal activity
Content that infringes intellectual property or privacy rights
Hate speech, harassment, or threats of violence
Sexually explicit or exploitative material, especially involving minors
Promotion of self-harm, suicide, or eating disorders
Deepfakes, impersonation, or unauthorized recordings
Attempts to interfere with or bypass security measures

5. AI Character Interactions

Please understand that:

AI characters are artificial and their responses are generated by algorithms
Conversations should not be considered as professional advice
AI responses may occasionally be inaccurate or inappropriate
The service is experimental and character behaviors may change
You should not develop unhealthy dependencies on AI interactions
AI responses are generated using third-party model providers (e.g., OpenAI, Google Gemini) under their own terms of service.
Your prompts, conversations, and other input content may be transmitted to and processed by third-party AI providers, including providers located outside your country, to generate AI responses and provide related features, and their terms and privacy policies may apply. Please avoid including personal data or sensitive information.
We do not use your content to train our own models. However, some third-party model providers or related providers used to generate AI responses may process your prompts and conversations for service improvement, quality enhancement, or model training purposes in accordance with their policies. Account identifiers are managed separately from chat data and are not transmitted to AI providers. Only chat data necessary to generate responses, such as character prompts and conversation content, may be transmitted to AI providers, so you should avoid including personal data or sensitive information in chats. If we later use your content for our own model training, we will provide prior notice and obtain consent, applying de-identification/pseudonymization and offering an opt-out.

6. Content and Intellectual Property

All content, characters, and intellectual property on nekochat are owned by nekochat or used with permission. You retain ownership of content you create, but grant nekochat and its service providers (including third-party AI/infrastructure) a worldwide, non-exclusive, royalty-free, sublicensable license to use it for operating, maintaining, improving the service, security/fraud prevention, backup, and legal compliance. Public marketing use requires separate consent. Upon deletion/termination, we remove it from live systems and roll backups off periodically; derived data (logs, statistics, de-identified data) may not be retrievable.

7. Experimental Nature

This is an experimental platform. Features may change, be removed, or experience downtime without notice. We are not liable for any loss of data or service interruptions that may occur during our experimental development process.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. As part of providing AI responses and related features, your input content may be transmitted to and processed by third-party AI providers, including providers located outside your country, as described in the Privacy Policy. By using our service, you acknowledge and consent to those data practices.

9. Limitation of Liability

nekochat and the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our liability is limited to the maximum extent permitted by law.

10. Termination

We may terminate or suspend your account at any time for violations of these terms. You may close your account at any time; upon closure, your right to use the service ceases immediately. When your account is closed, user data we kept to provide the service is deleted. Payment and transaction records are kept for the statutory periods (5 years for payment, contract, and withdrawal records, and 3 years for consumer-dispute records) and then destroyed. If you completed identity or adult verification, the linking identifier (CI) may be kept to prevent abuse and repeat signups. Backups expire on a periodic schedule. Statistics already counted, and records that cannot identify you, may remain. See the Privacy Policy for details.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.

13. User-Generated Content and Responsibility

nekochat is a platform for AI-based character interactions, and users may create or share content, including character prompts and conversations. You are solely responsible for any content you create or interact with. You represent and warrant that your content does not infringe third-party copyrights, trademarks, publicity rights, or confidential information, and you will indemnify nekochat for related claims. We may remove or restrict content that is offensive, unlawful, or infringing, and repeat infringers may face account restrictions or termination. You may report infringements via in-service reporting tools or email/Discord support; we will act on valid notices promptly and may provide a counter-notice channel. Users must ensure their contributions comply with applicable laws and community standards.

14. AI Output Ownership

AI-generated outputs (text, images, etc.) may have uncertain legal protection. You may use them on a non-exclusive basis, and nekochat may store and analyze such outputs for service quality, security, improvement, and legal compliance. You must use AI outputs without infringing others’ rights; you are responsible for any infringement claims.

15. Reporting and Takedown

If you suspect infringement (copyright, trademark, publicity rights, etc.), use the in-service reporting tools or contact us via email (zombcat@nekochat.xyz) or the #contact-us channel in our Discord server. Provide necessary information (identifiable links or screenshots, proof of rights, contact details). If the notice is valid, we will promptly remove or block the content and may offer a counter-notice channel. Repeat infringers may be restricted or terminated.

16. Mature and Sensitive Content

Some AI character interactions may involve fictional scenarios with mature or sensitive themes. nekochat manages content through its operating policies and automated review systems, but cannot guarantee in advance the suitability of every response generated by AI. Use discretion when engaging with AI characters. Adult content is available only to users aged 19 or older. Users under 19 may use safe content only.

17. Governing Law and Jurisdiction

These terms shall be governed by and interpreted in accordance with the laws of the Republic of Korea. Any disputes arising from or related to nekochat shall be subject to the exclusive jurisdiction of Korean courts.

18. Payments and Refunds

nekochat uses Toss Payments to securely process payments and Giftishow Biz to fulfill incentive-exchange coupons. By making a purchase or exchanging incentive points through our platform, you agree to the following:

You are responsible for reviewing the purchase details before confirming payment.
Refunds are permitted only for unused cat point packages within 7 days of purchase. Partial or full usage voids refund eligibility. Refunds may be issued after deducting payment processing fees already incurred. Paid cat points must be used within one year of the charge date, while promotional or free cat points must be used within one year of issuance and are consumed before paid cat points.
If model usage is billed on a metered basis, each model's usage price is determined by applying a 20% margin to the amount calculated from the token pricing schedule. The final number of cat points deducted may vary depending on the selected model, the actual number of tokens used, and the pricing criteria in effect at the time of use, and will be finalized based on the usage details or receipt shown to the user.
Canceled payments are processed through Toss Payments, and may take several business days to reflect depending on your payment method.
Coupons fulfilled through the incentive shop generally follow Giftishow Biz policy, including a default validity period of 30 days unless a product-specific exception applies.
Coupons issued through the incentive shop may be ineligible for extension or refund, and unused coupons that expire are not guaranteed to be cancelable or refundable.
Coupons issued through the incentive shop may not be resold using cash-equivalent payment methods.
Recipient information and delivery messages entered for incentive-shop exchanges may be shared with the fulfillment provider only to the extent necessary to issue and deliver the coupon.
For non-cash-equivalent goods over KRW 50,000, additional notices such as stamp-tax deferred-payment statements may be presented where required by law or provider policy.
